Who signs off on the file

The question that stops most brokers is not whether the work can happen outside the brokerage. It is whose name is on the approval.

Empower Transactions does not approve files. Your broker of record does.

Empower Transactions does the review — the document set, the requirement set for that state and that transaction type, the exceptions, the chase, and the record. What reaches your broker of record is a file that is already complete and a short list of anything that needs a decision. The sign-off stays with the license that carries the responsibility, because that is the only place it can sit.

Texas publishes this directly. TREC’s Rule 535.2(a) states that a broker “is responsible for the authorized acts of the broker’s sales agents, but the broker is not required to supervise the sales agents directly,” and 535.2(e) that a broker “may delegate to another license holder the responsibility to assist in administering compliance with the Act and Rules, but the broker may not relinquish overall responsibility for the supervision of license holders sponsored by the broker.” A vendor is not a license holder, which is why the sign-off stays where it is; the full reading of the Texas file is in Empower Transactions’ Texas transaction file requirements analysis. If you run a 100% or flat-fee brokerage

Your agents already pay for file review. It is a line on your schedule with a name they recognize.

eXp charges $25 a file for broker review. Real’s is $40, and its published schedule takes it to $50 on September 1, 2026. What that fee buys at most brokerages this size is one person who is also running onboarding and answering marketing questions.

That is the part worth looking at. Review revenue arrives per file. Review cost arrives per hour, in headcount you already carry. The two move apart exactly when recruiting is working — and recruiting is the whole business at a 100% shop.

Empower runs underneath the fee you already charge. Your schedule does not change. Your agents pay what they pay now. Your broker of record still signs off. What changes is who does the work, and what the person doing it today gets to do instead.

Fee figures are from the brokerages’ published agent fee schedules. Whether a brokerage may adjust what it charges its own agents, and how that must be disclosed, varies by state and is a question for your broker and your counsel.

Growing into another state

If the next agent you add is in a state you are not licensed in, three questions come first: what the four approvals are and how they sequence, which state requirements do not transfer from the state you already run in, and whether your back office can still keep the support promise at the agent count you are recruiting toward.

And if you are considering paying for coordination on your agents behalf as part of that offer, it is worth knowing what else that decision buys: brokerage-paid transaction coordination produces a reviewed file as a by-product, because it is the same pass over the same documents.
